PRIVACY POLICY

Gamma Basics LLC (the “Company”) takes the privacy of its customers seriously.  This Privacy Policy governs personal information the Company may collect from customers through the use of the Company’s Web site and related online or Web-based services (collectively, the “Site”); communications with the Company online and over the telephone; registration of software or other goods or services purchased, licensed, or otherwise provided by the Company; and otherwise requested from time to time by the Company in connection with its offering of goods or services. 

The Company may revise this Privacy Policy from time to time within its sole discretion with or without prior notice to you by updating this posting, with any such revised Privacy Policy taking effect immediately upon the date of posting.  Consequently, you should consult the terms regularly upon accessing the Site.  The Company will not send individual notices of changes to this Privacy Policy but will make copies available upon reasonable request.

SITE NOT INTENDED FOR MINORS

This Site is not directed to minors under age 13, and the Company will not knowingly collect personal information from any child under age 13.  To place an order or to contact the Company, you must have reached the age of majority (which in most jurisdictions is 18 years old) and have legal capacity to enter into a binding contract.  If you are under the age of majority in your home jurisdiction or cannot lawfully enter into a contract, you must advise your parent or legal guardian to review this Privacy Policy and any other conditions of sale or service that the Company may provide or publish from time to time before you place an order or enter into an agreement with the Company. 

The Company will not intentionally collect personal indentifying information from minors or incapacitated adults.  Should the Company discover or be informed that a minor or incapacitated adult has contacted the Company, placed an order, or otherwise requested services from the Company, the Company will take reasonable steps to delete any identifying information from its records.  If you, as a parent or legal guardian, are concerned that your child or other person under your lawful custody has contacted or placed an order with the Company, please contact the Company through the “Contact” link on the Site or by calling the Company at the telephone number provided.

Telephone calls to the Company may be recorded for security reasons and retained for a period determined by the Company.

PERSONAL INFORMATION COLLECTION AND USE

In order to place an order, request services, register a product, download upgrades to an existing product, receive technical support, or otherwise receive information, services, or products from the Company (collectively, “Company Services”) you may be required to provide valid and up-to-date personal information, which may include but shall not be limited to your legal name, phone number, mailing address, billing address, e-mail address, shipping address, company name, product identification numbers, and payment details (collectively “Personal Information”).  Should you contact the Company by telephone, you may also be required to provide one or more items of Personal Information.  Additional information may also be collected by the Company for security and anti-fraud purposes.

COOKIES AND ELECTRONIC INFORMATION

The Site may use technology such as “cookies” to store information about you or your computer, monitor and validate software or other product authenticity track selections and purchases, and otherwise facilitate interaction between your computer and the Site.  Cookies are pieces of electronic information stored on your computer.  You may disable cookies through the settings in your Web browser, but if you do so, some parts of the Site may not function properly.  The Company may automatically track and collect information about your IP address, your domain service, the type of computer and Web browser you are using, and the pages you visit (including by using Web beacon and other equivalent technology).  The Company collects this information to administer and improve the Site and underlying system.  The Company may share this information in the aggregate with third parties.

USE OF PERSONAL INFORMATION

The Company takes all commercially reasonable measures to ensure that your Personal Information is handled in a secure and proper manner.

The Company may use your Personal Information to provide Services; to send you information the Company believes may be of interest to you; for marketing research purposes relating to the Company’s business and satisfaction surveys; to customize, analyze, and improve the Company’s products, services, technologies, communications, and relationship with you; to prevent fraud and other prohibited or illegal activities; to enforce our conditions of sale, Terms of Use, or this Privacy Policy; and to protect the security or integrity of our Site, our business, or our products or services.  Your Personal Information may also be used to provide you with other Company Services you may have requested.  Your personal financial information will not be used for any purpose except for processing your order and completing the transaction, as set forth in this Privacy Policy or as requested by law.  Personal Information collected will be stored and processed in the United States.

Except as expressly provided in this Privacy Policy, the Company will not share your Personal Information with any unaffiliated third party without your prior consent or unless required to by law or legal process.  If the Company or substantially all of its assets are acquired as a result of an acquisition, merger, sale, reorganization, or liquidation, your Personal Information may be one of the transferred assets. 

Any Personal Information you make available to the Company is done so voluntarily, with your knowledge and consent when ordering or contacting the Company, or otherwise requesting or registering for any Company Services.  The Company may request Personal Information that is mandatory (required to fulfill your order or meet legal obligations) and non-mandatory.  You may elect to withhold any non-mandatory Personal Information.  If you refuse to provide the Company with any requested mandatory Personal Information, then the Company may not be able to process your order, respond to your communication, or otherwise provide you with requested products or Company Services.  Should any of the Personal Information you provide to the Company change, please contact the Company through the “Contact” link on the Site or by calling the Company at the telephone number provided.

JOINT USE OF PERSONAL DATA

In the event you provide credit card or billing information to the Company via the Site or otherwise in connection with any request for or performance of Company Services, the following information may be used jointly by the Company, any third-party vendor providing an online payment portal, and your credit card company to process payment of your request, as well as any third-party credit check or fraud prevention agency:

                  1. your name and address;

                  2. your credit card information;

                  3. the identification of the products you have ordered; and

                  4. the price paid for the products you have ordered.

Your credit card company is responsible for their use of your Personal Information, and you should contact your credit card company directly with regard to any matter concerning its use of your Personal Information.

SECURITY

The Company is committed to protecting the security of your Personal Information.  The Company employs commercially reasonable measures to ensure that your Personal Information is held securely.  In the absence of negligence on the Company’s part, the Company shall not be held liable for any loss you may suffer if a third party procures unauthorized access to any Personal Information you provide to us via the Site or when contacting the Company by telephone or otherwise.

YOUR RIGHTS

If you request disclosure, correction, deletion or that the Company stop using your Personal Information, the Company will deal with such requests in accordance with applicable laws and regulations.  The deletion of your Personal Information or a request for the Company to stop using your Personal Information may result in change or alteration of your customer status with the Company or may otherwise affect your use of and access to the Site and the Company Services.
